Exterior Modifications Overview

 
TOA’s Declaration Article XI “Architectural Standards” states “…no construction or modification shall take place except in strict compliance with this Article…” and further describes the processes by which exterior changes can be made.  In the parlance of the TOA, exterior home improvement projects, no matter the size or the scope, are referred to as “modifications.” This page provides a brief overview of why the TOA maintains control over modifications, what type of modifications require approval, the established process for gaining approval, and the governing document that provides all the details. Overview
 
Timarron is a master-planned community designed to be a place where one may live and play without leaving the familiar features of a home. These features, particularly architecture, and landscape, both natural and man-made, have been selectively woven into the Timarron infrastructure and serve to unite the community's function and visual appearance and affirm the sense of belonging and community pride of its inhabitants. This mandates that all homes within Timarron be harmoniously designed as a community with each of the 17 individual neighborhood themes supporting Timarron’s overall and unified motif. While individual style is important, overall neighborhood integrity and continuity is the primary consideration in deliberating any proposed change to a home in Timarron. Each proposed home modification regardless of scope and complexity must be compatible with the surrounding property. 
 
A modification is defined as an alteration, addition, or deletion to land or to an existing structure's exterior which alters the physical appearance, characteristics, or properties of the land or structure. The Modifications Committee (MC) has exclusive jurisdiction over modifications, additions, or alterations made to existing structures and open spaces. All property owners are responsible for obtaining the necessary review and approvals from the MC that comply with the terms of the Declaration of Covenants, Conditions, and Restrictions for Timarron (“CC&Rs”) and the Design Review Guidelines. Any improvement, modification, alteration, addition, or deletion must have MC approval prior to the commencement of construction or installation. Any approval or disapproval is given in writing. There are no exemptions or automatic approvals and each application is reviewed on an individual basis.
 
If the modification you are considering is not specifically covered in the Design Review Guidelines, you are still required to request approval for it. In other words, modifications to the exterior of your home require approval.
 
Modification Request Process
 
All applications for modification must be submitted to the MC in accordance with the procedures outlined in the Design Review Guidelines. The applicant must submit an application using the appropriate Modification Submission Request form as well as any specified supporting documentation such as scaled plans, site plans, building elevations, material, finish, and/or color schedules, and construction details. Compliance with all applicable building codes, zoning regulations, and other requirements of local agencies and municipalities (i.e., the City of Southlake or the City of Colleyville) is required. It is the responsibility of the applicant to obtain all necessary permits, inspections, and the final Certificate of Occupancy, if required. Regulatory approvals do not preclude the authority and responsibility of the MC for design review and vice versa. 
 
The MC typically renders a decision within 30 days for any application and will deliver by email and US mail a written decision. Any decision reached by the MC may be appealed back to the Board of Directors or to the New Construction Committee (NCC) for a variance request. The appeal must be in writing within 30 days after a decision by the MC has been rendered. All appeals will be reviewed on a case-by-case basis, and the granting of an appeal for one residence for a particular situation does not imply or warrant that a similar appeal would be granted on another residence. Each case will be reviewed on its own design merits, and in keeping with the overall objectives of the Guidelines.
 
The decision to grant a variance rests solely with the NCC, or in certain cases, the Board of Directors. The granting of a variance for one particular situation does not warrant or imply that a variance will be granted for the same or similar situation at another residence. Each variance request will be reviewed on a case-by-case basis, in keeping with the overall objectives of the Design Review Guidelines and the CC&Rs.
 
Design Review Guidelines
 
The Timarron Design Review Guidelines were established and are periodically updated to ensure a high level of design consistency throughout the community and to help establish an overall quality of character or “visual branding” for the community. The primary purpose of these Design Review Guidelines (the “Guidelines”) is to aid and direct owners of residential properties within Timarron. The Guidelines seek to establish a design framework that the homeowner will use as a guide for modifications, with latitude and flexibility, balanced against preserving the consistency and integrity of properties within Timarron. These Guidelines will serve to guide, inform, aid, and inspire to the same extent as they may prohibit, restrict, and require.
 
Design Review Guideline July 2023
 
These Guidelines are to be used as a framework for planning and implementing modifications to the exterior portion of your home and its surrounding landscape. They have been created to help maintain a community standard imparted by the original developers. With the passage of time, these standards have necessarily evolved to incorporate changing materials, techniques, technology, preferences, and regulations. The Guidelines contain the rules and/or requirements for specific modifications. Note that all neighborhoods have specific guidelines that may further define how a modification may be implemented in a specific neighborhood. A property on the golf course will have additional guidelines beyond those. 
 
These Guidelines may be amended by the NCC (subject to approval by the Board of Directors). It is the responsibility of all homeowners to utilize the most current edition of the Guidelines.
