Timarron Owners Association (TOA) is a Texas non-profit corporation and has a set of governing documents that determine how it can function.
Each governing document serves a specific purpose, yet they all interact with one another to create and maintain a community homeowner association. By purchasing in an association, you created a legally binding contract between yourself and the association. That contract is the important documents listed below:
- Articles of Incorporation
- Bylaws
- Declaration of Covenants, Conditions and Restrictions
- Rules and Regulations or Policies
- Design Review Guidelines
As part of the closing process, those purchasing homes in Timarron are provided access to these and other documents which have helped safeguard our community for more than thirty years. We also make some of these documents publicly available so that prospective residents can review them before purchasing a home here. Note that this is not a complete list of all our Governing Documents nor a complete description of each document. All documents can be found on the user portal, which can be accessed through

Articles of Incorporation
The Articles of Incorporation serve as legal proof of the establishment of a company in a state and provides the state government with certain basic information about the corporation.
Bylaws
After Timarron was incorporated, it adopted a set of bylaws. The primary function of the Bylaws is to establish the powers and duties of the Board and of the officers. Some examples of critical components of the Bylaws:
- Board of Directors structure, term of office, Director removal, no compensation.
- Powers of the Board (policy creation and enforcement, budget setting, etc.).
- Officer positions and powers (President, Treasurer, Secretary, etc.).
The Bylaws may be amended by the affirmative vote or written consent of Voting Members representing 67% of the total homes in the Association. For additional information, please refer to the full set of Bylaws.
Declaration of Covenants, Conditions and Restrictions
The Declaration of Covenants, Conditions and Restrictions (DCC&Rs or CC&Rs or “Declaration”) establishes the rights and responsibilities of the Association and the homeowners within it. It is truly the “meat” of the Association’s set of governing documents and it sets the framework for every other document after it. Some of the critical components of the Declaration include:
- Defining the types of homes that can be built, how to get approval to modify the exterior building or landscape, and so forth.
- Definition of Unit boundaries, defining “common areas” and components.
- Listing of maintenance responsibilities (ex: owners maintain their property and TOA the “common areas”).
- Owner restrictions (ex: residential use only and not business).
- Overall rights of the association (ex: approval of modifications, creating design standards, rule creation).
- Assessment procedures and requirements (annual assessments, special assessments, etc.).
- Association’s powers to collect dues.
The Declaration is a deed restriction on your home and effectively the contract between owners and the Association. This document outlines the basic parameters of our Association by defining terms and detailing the rights and responsibilities of our homeowner members. It clarifies property ownership by the Association and that of individual owners, thereby creating an interlocking relationship between all homeowners to one another and to the Association. Each home within Timarron is subject to the legally binding restrictions contained in the Declaration and the Declaration establishes the authority to collect assessments. The Declaration should be read by each homeowner with care. In case of a conflict, the terms of the Declaration override the terms of this site. Please note that the information included in this site only summarizes aspects of the Declaration. Please see the entire document and all current amendments. Policies, Rules, & Regulations
Association policies, rules, and regulations are authored by the Board of Directors to offer guidance regarding specific topics that are not outlined fully in the DCC&Rs or Bylaws. These have been developed over the course of our history as the Board members have determined the need for each one. Most relate to some aspect of the association’s daily operations. The Board reviews each policy, rule, or regulation on a regular basis to determine if any updates are appropriate. The Board also notes any changes to Texas Property Code that may mandate changes to existing policies, rules, and regulations or adoption of new ones. The following document contains a partial list of current Timarron Rules & Regulations.

Design Review Guidelines
One document that all homeowners need to be familiar with is the Design Review Guidelines. This document is commonly referred to as "The Guidelines” by homeowners. These are critical because Article XI “Architectural Standards” states “…no construction or modification shall take place except in strict compliance with this Article…” and further describes the processes by which exterior changes are made. This document governs all exterior modifications which owners make to their homes, to include the structure and the surrounding landscape in the front and the rear of the home. These clarifications become necessary as materials change, technology advances, or laws change or get created. The Design Review Guidelines are periodically reviewed and updated by the New Construction Committee (“NCC”). The NCC is granted this authority in the Declaration. The Design Review Guidelines apply to all homes in Timarron, and there are also neighborhood specific guidelines, particularly for landscaping, that have been established. Please consult the
